Please read these Terms carefully before creating an account, submitting a loan application, accepting a loan offer or using any part of the Services. By clicking accept, continuing in the App, submitting information, requesting a loan or otherwise using the Services, you confirm that you understand and agree to these Terms and to our Privacy Policy. If you do not agree with these Terms, do not access or use CreditGo.
1. Parties, Product and Scope
1.1 RAY FINTECH LIMITED is the operator of CreditGo. In these Terms, "we", "us" and "our" refer to RAY FINTECH LIMITED. "You" refers to the person who registers for, accesses or uses CreditGo.
1.2 CreditGo is designed for personal credit access, loan application, credit assessment, account management, repayment management, customer support and related financial technology services in Nigeria.
1.3 These Terms apply to the App, our website, any loan offer shown to you, repayment schedules, notices, support communications and any other terms incorporated by reference.
1.4 Where a specific loan offer or repayment schedule conflicts with a general provision in these Terms, the specific loan offer will apply to that loan only, unless the conflict is unlawful or inconsistent with mandatory consumer protection requirements.
2. Key Definitions
2.1 "Account" means the CreditGo user account created for your personal use.
2.2 "App" means the CreditGo mobile application and any related software, data, pages, tools or services made available through it.
2.3 "Business Day" means a day on which banks are generally open for business in Nigeria, excluding Saturdays, Sundays and public holidays.
2.4 "Credentials" means passwords, PINs, OTPs, biometric confirmations, T-PINs or other authentication methods used to access your Account or confirm a transaction.
2.5 "Credit Reference Bureau" means a licensed or authorized credit bureau or credit information service operating under applicable Nigerian law.
2.6 "Loan" means any credit facility, principal amount, interest, fee, charge, repayment amount or other amount made available or payable through CreditGo.
2.7 "Payment Provider" means a bank, payment processor, payment system operator, payment service bank, switching provider or other authorized payment service provider.
2.8 "Platform" means CreditGo, including the App, website, systems, account features, notices and related service channels.
2.9 "Third-Party Provider" means any bank, payment processor, identity verification provider, credit bureau, fraud prevention provider, analytics provider, technology provider, customer support provider, recovery service provider, professional adviser, regulator-facing service provider or other authorized provider that supports the Services.
3. Eligibility and Account Registration
3.1 You may use CreditGo only if you are at least 18 years old, legally resident in Nigeria, capable of entering into a binding contract and able to provide accurate information required for account opening, identity checks and loan assessment.
3.2 You must create and use your Account for yourself only. You must not sell, transfer, lend, rent, share or allow another person to operate your Account or Credentials.
3.3 You are responsible for keeping your Credentials confidential. If you suspect unauthorized access, loss of Credentials or misuse of your Account, you must notify us promptly through our support channel.
3.4 We may refuse registration, suspend an Account, restrict access or request additional checks where information appears incomplete, inaccurate, suspicious, fraudulent, unlawful or inconsistent with our risk controls.
4. Identity Checks, KYC and Information Verification
4.1 To provide the Services responsibly, we may ask you for information and documents needed for Know Your Customer checks, anti-money laundering checks, fraud prevention, credit assessment, responsible lending, repayment management and compliance with applicable law.
4.2 This may include your name, date of birth, phone number, email address, Bank Verification Number, address, government-issued identity document, selfie or facial verification, employment or income information, bank account information, repayment capacity information and other information reasonably needed for the Services.
4.3 You confirm that all information and documents you submit are true, accurate, current and complete. You must promptly update material changes, including changes to phone number, address, bank account, employment or repayment capacity.
4.4 You authorize us to verify information you provide against lawful sources, including official databases, banks, Payment Providers, identity verification providers, Credit Reference Bureaus, fraud prevention providers and other authorized sources.
4.5 Where biometric or camera-based verification is required, it will be used only for identity verification, liveness detection, fraud prevention, account security, loan application processing or legal compliance, as described in our Privacy Policy.
5. Credit Assessment and Loan Offers
5.1 You may apply for a Loan through the App where the feature is available. Submitting an application does not guarantee that a Loan will be approved.
5.2 We may approve, decline, vary, cancel, suspend or withdraw a credit limit or loan application based on verification results, credit risk assessment, repayment history, fraud controls, affordability checks, regulatory requirements, internal policies and other relevant factors.
5.3 Before you accept a Loan, the App or loan offer will display key loan information, which may include principal amount, disbursement amount, interest, fees, charges, repayment amount, repayment date, repayment term and other relevant conditions.
5.4 You must review every loan offer carefully before accepting it. If you do not understand or accept the displayed terms, you should not proceed and should contact customer support before confirming the Loan.
5.5 Acceptance may require an OTP, PIN, T-PIN, password, biometric confirmation or another authentication method. Once you accept a loan offer and the Loan is disbursed, you must repay it in accordance with the accepted terms.
6. Disbursement, Repayment and Payment Mandates
6.1 Approved Loans may be disbursed into your nominated bank account or another approved payment channel, subject to verification, payment processing and final approval.
6.2 You must repay principal, interest, applicable fees, taxes and any other amounts due on or before the agreed repayment date using the repayment channels made available to you.
6.3 You must ensure that your bank account, card, wallet or other repayment method has sufficient funds and remains valid for repayment.
6.4 Where you provide a repayment mandate, direct debit authorization or similar payment authorization, you authorize us and our Payment Providers to initiate, debit, charge or collect amounts due, subject to applicable law and the terms of the authorization.
6.5 Your loan history, repayment status, accepted loan terms and related transaction records may be displayed in the App or provided through another approved communication channel.
7. Interest, Fees and Pricing Disclosure
7.1 Interest, service fees, transaction fees, late fees, default interest, penalties and other charges will be disclosed to you before you accept a Loan where they apply.
7.2 Fees and interest may vary by loan amount, loan term, risk assessment, product type, repayment history, regulatory requirements and other applicable factors.
7.3 We may change pricing for future Loans, subject to applicable law. Unless permitted by law and clearly disclosed, a pricing change will not retroactively change a Loan that you have already accepted.
7.4 If you are unsure how an amount was calculated, contact customer support before accepting the Loan or as soon as possible after noticing an issue.
8. Late Payment, Default and Recovery
8.1 A default may occur if you fail to pay an amount when due, provide false or misleading information, breach these Terms, misuse the Services, use the Loan for unlawful purposes, become unable to pay your debts, invalidate a repayment method or take any action that materially affects repayment.
8.2 If a default occurs, we may, subject to applicable law, suspend access to further credit, declare outstanding amounts due, apply disclosed late fees or default interest, attempt recovery through authorized payment methods, report relevant information to Credit Reference Bureaus or regulators, refer the matter to lawful recovery providers, or commence legal proceedings.
8.3 Any collection activity must be lawful, proportionate and consistent with applicable consumer protection, data protection and debt recovery requirements. We will not publicly shame you, publish your debt to unrelated persons, use threats or harassment, or disclose unnecessary loan details to unrelated third parties.
8.4 We may contact you about overdue amounts through the App, phone calls, SMS, email, in-app notifications, letters or other lawful channels you provided. We may contact references or other persons whose details you lawfully provided only for lawful and proportionate purposes, such as locating you or verifying contact information, and in accordance with our Privacy Policy.
9. Credit Reporting and Third-Party Providers
9.1 You authorize us to obtain, use and share relevant credit, identity, repayment, default and account information with Credit Reference Bureaus, regulators, authorized credit reporting systems and other lawful recipients for credit assessment, responsible lending, fraud prevention, repayment management, regulatory reporting and compliance.
9.2 Third-Party Providers may support parts of the Services, including identity verification, BVN verification, payment processing, bank account validation, fraud detection, credit reporting, analytics, customer support, legal compliance and debt recovery.
9.3 We require Third-Party Providers to process information only for authorized purposes, use appropriate safeguards and comply with applicable data protection and confidentiality obligations.
9.4 Your use of a third-party service may also be subject to that provider's own terms or privacy policy where applicable.
10. Data Protection and Sensitive Permissions
10.1 We process personal information in accordance with our Privacy Policy. The Privacy Policy explains what information we collect, why we collect it, how we share it, how long we keep it and how you can exercise your rights.
10.2 CreditGo does not request access to your contact list, call logs, SMS content, photo library, video library, external storage, microphone, precise background location or full list of installed applications for credit scoring or loan recovery.
10.3 We may use coarse location or IP-based location, limited device information, App interaction information, account information, repayment information, identity verification information and in-app camera-based liveness verification where necessary for the Services and permitted by law.
10.4 You can manage App permissions through your device settings. Withdrawing a permission may affect features that depend on that permission, such as identity verification.
11. Acceptable Use
11.1 You must not use CreditGo for fraud, money laundering, terrorism financing, unlawful gambling, impersonation, unauthorized access, harassment, data scraping, reverse engineering, interference with the Platform or any other unlawful or abusive purpose.
11.2 You must not submit false information, misuse another person's information, bypass security controls, upload harmful code, disrupt the Services or use the Platform in a manner that may harm us, users, partners or the integrity of the Services.
11.3 You must use only official versions of the App and must not modify, copy, rent, sell, sublicense, decompile, disassemble or create derivative works from the App except where applicable law prohibits such restriction.
12. Service Availability and Changes
12.1 We aim to provide stable Services, but we do not guarantee that every feature will be available at all times or free from errors, delays, outages, network failures, payment failures, maintenance, cyber incidents, force majeure or third-party system issues.
12.2 We may update, change, suspend, withdraw or discontinue any feature for security, maintenance, compliance, operational, product or business reasons. Where a material change affects users, we will use reasonable efforts to notify users through appropriate channels.
13. Suspension, Closure and Cancellation
13.1 We may suspend, restrict or close your Account where required for security, fraud prevention, regulatory compliance, debt recovery, risk management, misuse of the Services, breach of these Terms or protection of users and the Platform.
13.2 You may request Account closure. We may complete closure after outstanding Loans, fees and obligations are settled and after legal, audit, accounting, fraud prevention, dispute resolution and regulatory retention requirements are satisfied.
13.3 Account closure does not cancel any existing repayment obligation, accrued fee, investigation, legal right, dispute or term that by nature should continue after closure.
14. Notices, Complaints and Customer Support
14.1 We may send notices, loan information, repayment reminders, security alerts, policy updates and other communications through the App, website, SMS, phone call, email, in-app notice or other contact details you provide.
14.2 You are responsible for keeping your contact details accurate and available. We are not responsible for missed notices caused by incorrect, outdated or unavailable contact information.
14.3 Questions, disputes, account discrepancies, loan discrepancies, complaints and privacy requests may be sent to support@rayfintech.com. We may ask for information needed to verify your identity and investigate your request.
15. Liability, Indemnity and Risk Allocation
15.1 To the maximum extent permitted by law, we are not liable for losses caused by your breach of these Terms, inaccurate information, unauthorized use of your Credentials, insufficient repayment funds, third-party failures, network interruptions, device issues, force majeure or circumstances outside our reasonable control.
15.2 Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15.3 You agree to indemnify RAY FINTECH LIMITED, its directors, officers, employees, affiliates, agents and service providers against claims, losses, liabilities, penalties, damages, costs and expenses arising from your fraud, unlawful conduct, breach of these Terms, misuse of the Services or violation of third-party rights.
16. Updates to These Terms
16.1 We may update these Terms from time to time to reflect product changes, regulatory requirements, risk controls, business operations or user protection measures.
16.2 Where a change is material, we will use reasonable efforts to notify you through the App, website, email, SMS or another suitable channel. Continued use of CreditGo after the effective date of updated Terms means you accept the updated Terms.
16.3 If you do not accept updated Terms, you must stop using the Services, but any existing Loan or repayment obligation remains payable under the terms accepted for that Loan.
17. Assignment, Severability and No Waiver
17.1 You may not transfer your Account, Loan obligations or rights under these Terms without our prior written consent.
17.2 We may assign, transfer, novate or otherwise deal with our rights or obligations in connection with service operations, financing, corporate reorganization, debt recovery, legal compliance, business transfer or similar lawful purpose, subject to applicable law.
17.3 If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply. A delay or failure to enforce a right is not a waiver of that right.
18. Governing Law and Dispute Resolution
18.1 These Terms are governed by the laws of the Federal Republic of Nigeria.
18.2 We encourage you to contact customer support first so that we can review and attempt to resolve any issue. If a dispute cannot be resolved through support, it may be submitted to the courts or other competent dispute resolution forum in Nigeria, subject to applicable law and any mandatory consumer complaint process.
